{"id":430,"date":"2024-07-01T01:01:52","date_gmt":"2024-07-01T01:01:52","guid":{"rendered":"https:\/\/christiedilemme.com\/blog\/?p=430"},"modified":"2024-07-03T01:38:18","modified_gmt":"2024-07-03T01:38:18","slug":"empowering-homeowners-floridas-new-bill-of-rights-for-hoa-members-takes-effect","status":"publish","type":"post","link":"https:\/\/christiedilemme.com\/blog\/empowering-homeowners-floridas-new-bill-of-rights-for-hoa-members-takes-effect\/","title":{"rendered":"Empowering Homeowners: Florida&#8217;s New Bill of Rights for HOA Members Takes Effect"},"content":{"rendered":"<p><span style=\"color: #000000;\">As of July 1, a groundbreaking new law has come into effect, significantly curbing the powers of homeowner associations (HOAs) in Florida. <\/span><\/p>\n<p><span style=\"color: #000000;\">This legislation, <a style=\"color: #000000;\" href=\"https:\/\/www.flsenate.gov\/Session\/Bill\/2024\/1203\" target=\"_blank\" rel=\"noopener\">HB 1203<\/a>, titled &#8220;Homeowners&#8217; Association,&#8221; is a comprehensive reform aiming to establish a Homeowner&#8217;s Bill of Rights.\u00a0<\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>Key Restrictions on Florida HOAs include&#8230;<\/strong><\/span><\/p>\n<p><span style=\"color: #910909;\"><strong>Uniform Rule Enforcement:<\/strong> <\/span><span style=\"color: #000000;\">HOAs can no longer enforce rules selectively among residents.<\/span><\/p>\n<p><span style=\"color: #910909;\"><strong>Parking Freedoms:<\/strong><\/span> <span style=\"color: #000000;\">Homeowners and their guests can park personal, business, or first responder vehicles (including pickup trucks) that are not classified as commercial vehicles in their driveways or any other legally permissible areas.<\/span><\/p>\n<p><span style=\"color: #910909;\"><strong>Access to Property:<\/strong><\/span><span style=\"color: #000000;\"> Contractors and workers can no longer be banned from homeowners&#8217; properties.<\/span><\/p>\n<p><span style=\"color: #910909;\"><strong>Garbage Can Fines:<\/strong><\/span> <span style=\"color: #000000;\">Residents will no longer be fined for leaving garbage cans at the curb or driveway within 24 hours of a scheduled trash collection.<\/span><\/p>\n<p><span style=\"color: #000000;\"><span style=\"color: #910909;\"><strong>Holiday Decorations:<\/strong> <\/span>HOAs cannot fine residents for holiday lights or decorations that remain up past the stipulated period without prior notice.
